Terms of service

1. Scope

These terms govern the contract between PatientEd Saad, Brauerstrasse 87, 8004 Zürich (the "Provider") and natural persons who purchase a free or paid subscription to the DIOPTRA learning platform via dioptra.amrsaad.de (the "User").

Conflicting or differing terms from the User are not accepted unless their applicability is expressly agreed to in writing.

2. Subject matter of the contract

DIOPTRA is a web-based learning platform (Progressive Web App) for preparing for the postgraduate ophthalmology examinations of the International Council of Ophthalmology (ICO): Visual Sciences, Optics · Refraction · Instruments, Clinical Ophthalmology and Advanced. The Provider supplies verified multiple-choice questions (MCQs) and adjudicates the answer against a stored answer key with primary-source citation.

DIOPTRA is not a medical device. The content is intended solely for examination preparation and must not be used as the basis for clinical decisions in patient care.

3. Plans and services

3.1 Free Preview

  • 30 curated cards, drill mode only (no Deep Review answer evaluation).
  • Free of charge, no time limit, terminable any time by deleting your account.
  • Email signup required, no payment details.

3.2 Exam Bundle

  • Price: USD 99 (early-bird price for the first 100 buyers, publicly counted; thereafter USD 199 standard).
  • Term: 6 months from the purchase date, with a hard expiry 7 days after the chosen exam date (whichever comes first).
  • Access: all 14 subspecialty areas, drill and Deep Review unlimited.
  • Notice on launch scope: approximately 125 curated cards at launch, with at least 25 new cards added per week.
  • One-time payment, no auto-renewal.

3.3 Annual

  • Price: USD 249 per year.
  • Term: 12 months from purchase date, not tied to a specific exam date.
  • Same content as Exam Bundle, plus full access to the growing card archive.
  • Auto-renewal is off by default. Users receive an email 30 days before expiry and can renew actively.

3.4 Repeater (re-sit)

  • After the Exam Bundle expires, a new 6-month bundle cycle can be purchased for USD 99 (the repeater price is independent of the first-100 price ladder).
  • A one-time free 6-month extension is granted if the user defers or fails the exam. An informal email to amr@dioptra.amrsaad.de is sufficient.

4. Conclusion of contract

The contract is concluded upon successful payment via Stripe. By clicking "Get Exam Bundle" (or "Get Annual"), the User submits a binding offer to buy, which the Provider accepts by confirming payment and unlocking access.

5. Right of withdrawal for digital content

Important:by actively ticking the checkbox "I agree to begin access immediately and waive my 14-day right of withdrawal" at checkout, the User waives the 14-day withdrawal right under Art. 40a ff. Swiss CO and equivalent EU consumer protection rules (EU Directive 2011/83/EU, Art. 16(m)), because the service is unlocked in full immediately.

Without this checkbox, access is only unlocked after the 14-day withdrawal period elapses.

6. User obligations and account

  • Users may only use the platform for personal, non-commercial study purposes.
  • Sharing the account with third parties is prohibited.
  • Screenshots of individual cards for personal study are permitted. Systematic scraping, redistribution, or publication of individual cards or card sets is prohibited.
  • The Provider may suspend accounts with demonstrable misuse without refund.

7. Availability

The Provider targets an availability of at least 99% per year on average. Maintenance is announced where possible and scheduled during low-traffic periods. For continuous outages exceeding 48 hours, the Bundle term is extended accordingly.

8. Warranty and liability

The Provider is fully liable for intent and gross negligence. For slight negligence, the Provider is only liable for breach of an essential contractual obligation (cardinal duty), limited to the typical, foreseeable damage and capped at the Bundle price paid.

No warranty regarding examination outcomes. DIOPTRA is a study tool. The Provider does not guarantee passing the examination. Examination success depends on individual effort, clinical experience, and other factors outside the platform.

9. Price changes

Active subscriptions are not affected by price changes. Prices for new purchases are announced on the pricing page at least 14 days in advance.

10. Termination

  • Free Preview: any time via account deletion in Settings.
  • Exam Bundle and Annual: one-time payments without auto-renewal, so no formal termination is required. Account deletion is possible at any time. Refunds only within the right of withdrawal (see clause 5).

11. Governing law and venue

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods.Place of jurisdiction is Zürich, Switzerland. For consumers domiciled in the EU, the consumer-protection venue at the consumer’s place of residence additionally applies.

12. Online dispute resolution (ODR)

The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.

13. Severability

Should any provision of these terms be invalid, the validity of the remaining provisions is unaffected. The invalid provision is replaced by one that comes closest to the economic intent.
